I did some web work for a client/friend (not anymore) and now he is refusing to pay me and saying that he’s got a lawyer and that everything I did was his. How would I go about in taking legal action to get paid?
Alex: I’ve got questions about the America Invents Act. I’ve been hearing a lot about moving from a “first to invent” to a “first to file” system, and I think I understand the ramifications of that. I’m wondering, though, how important in the intellectual property prosecution and protection process, will things like signed dated notebooks be? I mean, if the rights of an invention are now going to be assigned to whoever gets to the patent office first, is it still important at all to prove that you hatched the idea on a specific date?
What’s the Difference Between Separation and Divorce? And More Free Legal Advice – Free Joe Friday 9/9/11
Candy: What’s the difference between separation and divorce? Joe Escalante: A divorce ends the marriage permanently. A legal separation does not. Is it possible to appeal a Small Claim Court decision, especially if additional evidence was provided, that wasn’t presented in the initial Small Claims Court hearing?
My son’s father passed away 1 1/2 yrs ago and had a life insurance policy but unfortunately did not make his last payment. The payment was due in October and he died in January. We spoke directly to the insurance company and they denied the claim because of the missing payment. We contacted the state insurance dept and they stated the company did not break any state laws. Is there anything else we can do to fight the insurance company?
I registered a Trademark for my product’s name. Apparently I registered it as a logo mark. Does this protect the name also? Or just the logo style?

Sasha: I am wanting my step dad to adopt me (an adult adoption). I live in Harris County and he lives in Grimes County. can you tell me what steps we need to takd and which County we need to take them in to get this taken care of?
Joe Escalante: It probably doesn’t matter which county, but you need to familiarize yourself with the adult adoption laws in your state. Some states only allow adult adoption if the person to be adopted is of diminished capacity. Some states require the consent of the spouse of the person to be adopted, some require notification of biological parents , and some require nothing more than the consent of the adult parties.
I’m looking at my first real commercial lease agreement for a bigger space.. Lots to consider in this economy! Among the 32 pages of legalese, are there any common ‘gotchas’ that I should be looking out for?
